Wrongful Death

A wrongful death lawsuit is a claim against a person or persons who can be held liable for a death. If a person is killed because of wrongful conduct or negligence, the decedent’s heirs and other beneficiaries may file a wrongful death claim against the responsible party for the decedent’s death.

The law of each state governs the amount of damages allowed to beneficiaries. Compensatory damages, which are intended to make restitution for the amount of money lost, are the most common damages awarded in wrongful death claims. Wrongful death lawsuits may recover medical and funeral expenses in addition to the amount of economic support beneficiaries could have received if the decedent had lived and, in some instances, a sum of money to compensate for grief or loss of services or companionship.

Determining the amount of damages in a wrongful death lawsuit requires taking into account many variables. To compute compensation, the salary the decedent could have earned may be multiplied by the number of years he/she most likely would have lived and can be adjusted for various factors, including inflation. Standard actuarial tables serve as guides for the life expectancy of particular groups identified by age or gender. The decedent’s mental and physical health, along with the nature of his/her work, may also be taken into consideration by a jury.

If you have lost a relative or a loved one as a result of someone’s negligence or a company’s defective product, the law permits you to seek compensation on behalf those who have been killed. You may be entitled to the lost income of the deceased, along with compensation for your loss. But, your time to file these types of lawsuits is limited by statute.
